SHAH ALAM: Lorry driver M. Rajisegar was once again found guilty and sent to jail for causing the death of a computer technician.
The High Court yesterday sentenced Rajisegar, 30, to eight years' jail after finding him guilty of culpable homicide not amounting to murder in the death of Muhamad Nazri Ismail, who was also a Cheras Umno Youth member.
He was convicted of committing the offence with a "steering wheel lock" in a road rage related attack in Jalan Persiaran Kewajipan, Subang Jaya, between 8.15am and 8.30am on Jan 25, 2005.
In her decision, judge Datuk Zaharah Ibrahim said she found no evidence to show there was any grave or sudden provocation. She, however, found that the prosecution had failed to prove a case under murder. However, she was satisfied that the accused had caused the victim's death.
In 2005, Rajisegar and another man, S. Gunasegaran, were charged with murdering Nazri.
At the end of the prosecution's case, the High Court reduced the charge to culpable homicide and they were ordered to enter their defence.
In 2008, the court found them guilty of culpable homicide and sentenced them to seven years' jail. Both finished serving their time in jail on Oct 2, 2009.
The prosecution subsequently filed an appeal against the court's decision to reduce the charge and it was allowed. The case was then sent back to the High Court and both accused were ordered to enter their defence for murder.
Rajisegar was re-arrested on Jan 24 this year, but Gunasegaran could not be located. Yesterday, Zaharah, in sentencing Rajisegar, said she had taken into consideration his initial seven years' jail and remand since January.
Earlier, counsel Rajpal Singh, who represented Rajisegar, pleaded for leniency, saying his client had already finished serving his jail term.
"He was released from prison on Oct 2, 2009, and got married on June 6 last year.
"His wife is now six months' pregnant and he is supporting his family and aged parents.
"Deputy public prosecutor Siti Rafidah Zainuddin, however, pressed for the maximum sentence as a lesson to the accused. - NST
